Car Stopped Hazards On, Accident Behind Is it my fault?

-Hey So Please only serious answers.



My mothers car broke down on the side of the road. She got as far over as she could and put her hazards on. Then after being there for an hour and no problems a car breaks abruptly and the car behind that car hits it. They are trying to blame it on my mom, but it's not her fault because she was stopped with her hazards on and was doing everything she could legally do when her car has broken down. It's the other persons fault because they weren't paying attention to there surroundings right? When I was in an accident a year ago because a person was breaking abruptly I was still the one who got in trouble because the judge said I wasn't paying attention to my surroundings. Like I said serious answers only. I am just looking for outsider feedback on the situation.



ThanksNo, it's not the fault of the driver who is stopped on the side of the road. It's the fault of the driver who hit the car in the front, no matter how abruptly the car in the front stopped for whatever reason. There's a minimum stopping distance that the car which is following, has to keep for situations like this. It seems that the driver in the car which hit the car in the front was either not paying attention or was driving so close to the car in the front that (s)he did not have the time to stop when the car in the front abruptly stopped.
Sorry misread the question. Her car was NOT in the accident and thus was not part of nor liable for any of the damages in the accident. The driver was following too close (a ticket-able offense) and is trying to find someone else to blame. It is his fault and no one else's.
Uh, she shouldn't have sat in the car doing nothing for an hour. Tell her to pop it in neutral and push it on the shoulder next time. Or, you know, get someone to tow it. It sucks but bad things happen when you're lazy.
